DominionAMS is a software platform owned and operated by Lehigh Partners Senior Benefits (“Lehigh Partners,” “we,” “us,” or “our”). These Terms of Service govern your access to and use of the DominionAMS website, application, and related services (collectively, the “Service”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.
DominionAMS is a product and service of Lehigh Partners Senior Benefits. Payments for DominionAMS are processed for Lehigh Partners Senior Benefits, and Stripe or your card issuer may identify the merchant or charge using the name Lehigh Partners Senior Benefits or a related billing descriptor.
1. Description of the Service
DominionAMS is a Customer Relationship Management (CRM) and Agency Management System (AMS) designed primarily for insurance agents and agencies. Features may include client and prospect management, policy tracking, commissions, tasks and reminders, reports, document storage, data export tools, integrations, and related agency workflows.
We may add, modify, replace, or discontinue features as the Service evolves.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. By using DominionAMS, you represent that you have authority to do so and will use the Service only for lawful business purposes.
3. Account Registration and Security
You agree to provide accurate account information, maintain the confidentiality of your login credentials, and accept responsibility for activity occurring under your account. You must promptly notify us if you suspect unauthorized account access or a security issue.
4. Acceptable Use
You may not use the Service to:
- Violate applicable laws, regulations, licensing requirements, or third-party rights.
- Transmit malware, malicious code, or harmful content.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Reverse engineer, exploit, scrape, or interfere with the Service except where such restrictions are prohibited by law.
- Disrupt the Service or use it in a manner that creates unreasonable security or operational risk.
We may suspend or terminate access for misuse, security concerns, nonpayment, or violation of these Terms.
5. Insurance and Regulatory Responsibility
DominionAMS provides software tools only. Each user and agency is responsible for its own compliance with applicable laws, regulations, carrier requirements, licensing rules, privacy obligations, recordkeeping requirements, and Medicare/CMS rules that apply to its business.
DominionAMS and Lehigh Partners Senior Benefits do not provide legal, tax, or regulatory advice through the Service.
6. Data Ownership
Users retain ownership of client information, policy information, documents, notes, and other materials they enter or upload to the Service (“User Data”). DominionAMS does not claim ownership of User Data.
You grant Lehigh Partners Senior Benefits a limited right to host, process, transmit, back up, and otherwise handle User Data only as reasonably necessary to operate, secure, support, and improve DominionAMS and to comply with applicable law.
7. Data Export and Backups
DominionAMS may provide tools that allow users to export portions of their data. Users are responsible for maintaining any backups or exports they require for their business, compliance, or recordkeeping needs.
8. Local Data Storage
Certain DominionAMS features may store information locally within a browser or device. We are not responsible for loss of locally stored information caused by device loss, browser clearing, local storage deletion, or other actions outside our control.
9. Fees, Billing, Cancellation, and Access
Paid DominionAMS subscriptions are billed according to the plan and billing cycle selected at purchase. Unless otherwise stated, subscriptions renew automatically until canceled.
You may cancel your subscription at any time. Cancellation stops future automatic renewals. Your account will remain active through the end of the current monthly billing cycle that has already been paid for, and you will not be billed for another cycle. Access to the account and paid features will end on the final day of that billing cycle.
- Cancellation does not end access immediately unless we specifically state otherwise.
- If a renewal charge has already been successfully processed before cancellation, that payment begins the new paid billing cycle and access continues through the end of that cycle.
- Unless required by law or expressly stated otherwise, amounts already paid are non-refundable and are not prorated for partial billing cycles.
- You are responsible for exporting any information you wish to retain before your access ends.
Because DominionAMS is owned and operated by Lehigh Partners Senior Benefits, subscription charges may appear through Stripe under Lehigh Partners Senior Benefits or a related billing descriptor.
10. Beta and Experimental Features
We may offer beta, preview, or experimental functionality. These features may change without notice, may contain errors, and may be modified or discontinued at any time.
11. Service Availability
We work to keep DominionAMS available and dependable, but uninterrupted or error-free operation is not guaranteed. Maintenance, updates, third-party outages, security events, or circumstances outside our control may temporarily affect access.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
13. Limitation of Liability
To the maximum extent permitted by law, DominionAMS and Lehigh Partners Senior Benefits will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.
To the maximum extent permitted by law, our total aggregate liability relating to the Service will not exceed the amount you paid for DominionAMS during the twelve months immediately preceding the event giving rise to the claim.
14. Suspension and Termination
We may suspend or terminate accounts that violate these Terms, create security or legal risk, misuse the Service, or remain unpaid. User-requested cancellation of a paid subscription is governed by Section 9 above.
Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and governing law—will survive termination.
15. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted with a new effective date. Continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
